Terms of Sale

These terms apply to every order placed with House of MBALI. Please read them before ordering; placing an order confirms your acceptance of them.

1. Who you are contracting with

House of MBALI, an atelier based in Cape Town, South Africa, established 2017. Correspondence: admin@houseofmbali.com. Full company registration and VAT details are provided on your order confirmation and invoice.

2. Orders

Every piece is made to order. A configuration submitted through the site is an invitation to treat, not a binding sale; a contract is formed only when we confirm your order in writing and allocate a hide to it.

We may decline an order where the hide requested is unavailable, where import of game leather into your country is restricted, or where we cannot verify payment.

3. Prices and payment

Prices are shown in euro and exclude import duties and local taxes, which are payable by the client unless we agree a landed-cost quotation in writing. The price is confirmed at order confirmation and does not change afterwards.

A deposit of 50% is payable to commence making, with the balance due before dispatch, unless we agree otherwise in writing.

4. Making and delivery

Current making time is ten to sixteen weeks from confirmation. Making times are estimates given in good faith; we will tell you promptly if a date moves. Risk passes on delivery, and title passes on full payment.

5. Cancellation and returns

Orders may be cancelled in full before cutting begins. Unpersonalised pieces may be returned within 14 days of delivery, unused and in original condition. Personalised and commissioned pieces cannot be returned except where faulty or not as described. The full policy is set out under Client Services.

6. Natural materials

Pieces are made from wild hide. Variation in grain, tone, scarring and markings is inherent to the material and is not a defect. Photographs on this site are representative of a silhouette, not of the individual hide allocated to your piece.

7. Liability

Nothing in these terms excludes liability for death or personal injury caused by negligence, for fraud, or for any liability that cannot be excluded by law. Subject to that, our liability in connection with an order is limited to the price paid for the piece.

8. Governing law

These terms are governed by the laws of South Africa. Where you order as a consumer, you keep the benefit of any mandatory consumer protections available to you in your country of residence.
